  1. The publisher of the website dartom.eu is the company Dartom Sp. z o.o.
  2. The website performs the functions of obtaining information about users and their behaviour in the following ways: 
    • By voluntarily entering information in forms.
    • By storing cookie files (so-called "cookies") in the end devices.
    • Through the collection of web server logs by the hosting operator.

2. Information in forms.

  1. The service collects information voluntarily provided by the user.
  2. In addition, the service may record information about the connection parameters (time stamp, IP address).

  1. The Website uses cookies.
  2. Cookies (so-called "cookies") are IT data, in particular text files, which are stored on the Service User's terminal equipment and are intended for use on the Website. Cookies usually contain the name of the website from which they originate, the time of storing them on the terminal equipment and a unique number.

    • creation of statistics that help to understand how Service Users use websites, which allows to improve their structure and content,

    • maintaining a session of the User of the Website (after logging in), thanks to which a User does not have to re-enter his/her login and password on each subpage of the Website.

  1. Information about certain user behaviour is subject to logging at the server layer. This data is used exclusively for the administration of the website and to ensure the most efficient operation of the hosting services provided.
  2. The resources viewed are identified by URLs. In addition, the following may be recorded: 
    • the time of arrival of the request,
    • the time of sending the response,
    • name of the client station - identification via HTTP protocol,
    • information about errors which occurred during the HTTP transaction,
    • the URL of the page previously visited by the user (referer link), if the user accessed the Website via a link,

  1. The Administrator of the Customers' personal data is Dartom Sp. z o.o. with its registered office in Grodzisk Mazowiecki, address: Bałtycka 50 Street, 05-825 Grodzisk Mazowiecki.
  2. The Administrator shall process your personal data on the basis of Article 6(1)(b) of the RODO, i.e. the processing is necessary for the performance of a contract to which the data subject is a party or to take steps at the request of the data subject prior to entering into a contract.
  3. Your personal data may be made available to other authorised entities on the basis of the law, as well as to entities with whom the controller has entered into an agreement for the entrustment of data processing in connection with the provision of services to the controller (e.g. law firm, software provider, external auditor)
  4. The controller does not intend to transfer your personal data to a third country or international organisation; You have the right to obtain a copy of your personal data at the controller's premises.

In addition, in accordance with Article 13(2) of the RODO, we inform you that:

  1. Your personal data will be stored until the expiry of the limitation period under the Civil Code Act of 23 April 1964.

  3. The provision of personal data is voluntary, however, necessary for the conclusion of the contract. The consequence of failing to provide personal data will be that the contract will not be fulfilled.

RESPONSIBILITY OF SOCIAL NETWORK OPERATORS

We have limited influence over the processing of data by Social Network Operators (e.g. management of users and the information they make available).To the extent that we are able to do so, we endeavour to ensure that their actions comply with data protection principles. In principle, however, it is the Portal Operators who decide how they process data.

The Operator operates the entire IT infrastructure of the service, has its own privacy policy and maintains its own relationship with you. Furthermore, the Operator is solely responsible for all issues relating to your data on your user profile to which we do not have access.

PURPOSES OF DATA PROCESSING

We process your personal data in order to:

  • managing our social media profile, including for the purposes of ensuring order and safety for participants in discussions on our profiles, including the removal of comments that violate the law, decency or the rules of the social network on which we operate our profile,
  • to maintain correspondence with you and any topics you contact us about,
  • promote our events,
  • analyse the activity of our profiles' users, including collecting data on the number of likes, comments and shares on our profiles or the content posted on them,
  • running competitions on our profiles.

LEGAL GROUNDS FOR PROCESSING

We process your personal data on our profiles based on our legitimate interests (Article 6(1)(f) RODO), which include:

  • ensuring order and security on our profiles by moderating users' posts and comment,
  • building positive relationships with users of our profiles in particular by corresponding with them and organising competitions,
  • promoting events,
  • analysing the activity of users of our profiles in order to best adapt the content posted there to their needs.

In the case of competitions, if you are the winner of a specific competition, we will also process your personal data in order to fulfil our tax obligations related to the settlement of the prize (Article 6(1)(c) RODO), resulting, inter alia, from the provisions of the Personal Income Tax Act of 26 July 1991.

PROCESSING PERIOD

Depending on the purposes for which your personal data is processed on Our profiles, We process it for the following periods:

  • in the case of your referrals - for the period necessary to answer your questions and for evidential purposes - for a period of 3 years after we have answered you,
  • in the case of the promotion of our events - until you object to the use of your data for this purpose, but for no longer than the period during which you follow us,
  • in the case of activity analysis, until such time as you object to the use of your data for that purpose and we consider that your objection is justified, but for no longer than the period for which you are monitoring us,
  • in the case of our profiles, until you have objected to the use of your data for this purpose and we have deemed that your objection is justified, but for no longer than the period for which you are monitoring us,
  • in the case of competitions, for the duration of the competition and for a period of no more than 3 years after the end of the competition in question, inter alia, for the purpose of asserting or defending against claims related to the competition in question. If you are the winner of a competition, we will process your data for a period of 5 years counting from the end of the calendar year in which the deadline for payment of tax related to the awarding of the prize expired in accordance with tax law.

RECIPIENTS OF YOUR DATA AND TRANSFERS TO THIRD COUNTRIES

Recipients of your personal data may be: the provider of the social network on which we maintain a profile - Facebook, YouTube and providers of marketing services, services for handling correspondence with users and state authorities (e.g. police, prosecutor's office, President, Office for Personal Data Protection).

Your personal data may be transferred to third countries (outside the European Economic Area-EEA), as some of our suppliers are based outside the EEA. In connection with the transfer of your data outside the EEA, we have ensured that our suppliers provide guarantees of a high level of protection for your personal data. These guarantees derive in particular from the obligation to apply the standard contractual clauses adopted by the (EU) Commission.

RIGHTS UNDER THE RODO:

You have the right to:

1. access to your personal data, including obtaining a copy of it,

2. rectification of your personal data,

3. request the erasure of your personal data ("right to be forgotten"),

4. request the restriction of the processing of your personal data,

5. to object to the processing of your personal data where we are processing it on the basis of our legitimate interest,

6. lodge a complaint with the President of the Office for the Protection of Personal Data (https://uodo.gov.pl), in particular if you believe that your personal data is being processed incorrectly.

DATA VOLUNTARINESS

The provision of personal data by you is voluntary, however it may be necessary to enable you to interact with us within the profiles we maintain (e.g. to answer some of your queries, to process a complaint, to enable you to enter a competition and award a prize).
